Terms and Conditions of Sale

These terms and conditions of sale apply to every quote, order and sale of nets and accessories by Filmar Industries Inc. (9148-0921 Québec Inc.), "Filmar". They complement the quote and the order confirmation. If the quote and these terms conflict, the quote prevails. They are written first for our commercial, institutional and municipal clients.

1. Quotes

  • A quote is valid for 30 days from its issue date. After that, we review it, because material costs change.
  • A quote already issued keeps the terms in force on its issue date.
  • Prices are in Canadian dollars unless the quote states otherwise.
  • Taxes and shipping are extra unless the quote states otherwise.

2. Custom orders

  • Every net is cut and assembled to the specifications of your order.
  • The order confirmation repeats the accepted quote exactly as written. We build to that document, so please check the dimensions and specifications before you confirm that everything is correct.
  • The client is responsible for the dimensions they supply. A dimension problem must be reported to us in writing within 15 days of delivery. A rebuild or change caused by wrong dimensions supplied by the client is at the client's expense.
  • Projects with poles installed by a partner: net fabrication starts only after the poles are installed and the final dimensions are measured on site. The production time runs from that confirmation.

3. Service levels and production times

The client chooses the service level when ordering. The price depends on the level chosen.

  • Emergency : about 2 weeks, on request.
  • Priority : about 3 to 4 weeks.
  • Regular : about 7 to 8 weeks.
  • Economy : 16 weeks or more, on request.
  • These times are approximate and given as a guide. Filmar does not guarantee production times.
  • The time shown is the production time until the order is ready to ship from our plant in Saint-Fabien. Transit time is extra.
  • Production time starts when the order is confirmed and, when a deposit is required, when the deposit is received.
  • Production times vary with the shop's workload and the size of the order.

4. Payment

  • New clients : a 50% deposit confirms the order and starts production. The full balance is due before shipping.
  • Orders shipping outside Canada, new or existing clients: a 50% deposit confirms the order. The full balance, shipping included, is due once the order is finished and before it ships.
  • Existing clients in Canada : according to your account terms. Unless otherwise agreed, our invoices are payable net 15 days.
  • Projects with poles installed by a partner : two separate invoices. The installation partner bills the poles and their installation directly, and Filmar bills the nets and hardware. A 30% deposit is required on each invoice. The balance of each invoice is payable net 30 days after delivery of that item.
  • Resellers and distributors : according to the distribution agreement.
  • Payment methods :
    • credit card, with the payment button in the invoice email;
    • Interac e-transfer to info@filmarnets.com;
    • direct deposit, bank details at the bottom of the invoice.
  • Late payment : any amount unpaid when due bears interest at 2% per month, that is 24% per year (simple interest).
  • Ownership : the goods remain Filmar's property until paid in full.

5. Taxes and duties

  • Applicable taxes are added to the price: GST and QST, or HST, depending on the province of delivery.
  • Orders exported outside Canada are not subject to GST and QST.
  • For orders shipping outside Canada, customs duties, import taxes and clearance fees in the destination country are paid by the client.

6. Shipping and delivery

  • Shipping costs are paid by the client unless the quote states otherwise.
  • We ship by parcel carrier or by LTL freight on a pallet, depending on weight and size. The approximate weight of each net is on the quote.
  • When the shipping cost is not known at quote time, it is confirmed on the invoice once the packing is set, because it depends on the real total weight.
  • You receive the tracking number when the order ships.
  • Transfer of risk : risk passes to the client as soon as the goods leave our shop, when they are handed to the carrier. When Filmar books the transport for the client, it is at the client's cost and risk. For international orders, the Incoterm is FCA, Filmar's shop in Saint-Fabien (Incoterms 2020), unless the quote states otherwise.
  • International orders: the proforma invoice is a PDF document (packed dimensions, weight, declared value, HS code). We photograph the packaging before it ships. If you work with your own freight forwarder, you coordinate with them directly.
  • Damaged or incomplete delivery : note it on the carrier's delivery receipt and report it to us within 5 business days of receipt, with photos.

7. Installation

  • Filmar makes the nets. Where an installation partner covers the area, poles and their installation can be part of the project: the partner does the work, bills it directly and answers for the installation. Filmar answers for the nets it makes.
  • Outside those areas, and for orders shipping outside Canada, the order covers the nets only. Poles, structure and installation are then the client's responsibility.
  • When the client or a third party does the installation, Filmar is not responsible for the installation or for damage it causes, unless that damage results from a defect in the net made by Filmar.

8. Cancellations and returns

  • Before production starts, an order can be cancelled in writing. The deposit is refunded, less costs already incurred (materials ordered or cut, preparation).
  • Once production has started, the order can no longer be cancelled.
  • Custom-made products are not returned or exchanged.

9. Warranty

  • We offer a lifetime warranty on all our products, covering manufacturing defects, including errors, omissions or imperfections that may occur during production. However, this warranty does not cover breakage caused by normal wear or misuse.
  • "Lifetime" means the useful life of the net under normal use.
  • For a covered defect: free repair or adjustment of the net, transport costs included.
  • We repair only nets made by Filmar.
  • Details: Filmar Warranty page (/en/resources/filmar-warranty/).

10. Claims

  • For any claim (warranty, delivery, conformity), email info@filmarnets.com or call 418-736-5717.
  • Give your order or invoice number and attach photos of the problem.
  • The time limits in section 2 (dimensions, 15 days) and section 6 (damaged delivery, 5 business days) apply.

11. Governing law

  • These terms are governed by the laws in force in Quebec and the federal laws of Canada that apply there.
  • Any dispute is heard by the courts of the judicial district of Terrebonne, sitting in Saint-Jérôme.
  • Where the buyer is a consumer under Quebec's Consumer Protection Act, these terms do not limit the rights that Act gives them.
  • Nothing in these terms limits Filmar's liability for bodily or moral injury, or for intentional or gross fault.
  • The French version of these terms prevails over any translation.

12. Changes

  • These terms may change. The version that applies to your order is the one in force on the date of your quote.
